Assessor, CPA to provide FREE Tax Workshop for Domestic Partners

County Assessor Larry Stone and Rich Waterman, a CPA and partner in Sparkman and Waterman, LLP will lead a FREE “nuts and bolts” workshop on federal and state income and local property taxes sponsored by the Billy DeFrank Center in San Jose. Focused on helping Domestic Partners, same sex couples and senior citizens over 62, the presentations will go over recent changes in law, as well as steps taxpayers can take to legally minmize their tax liability.

Participants can expect to learn more about how the recently enacted law for Domestic Partners (SB 1827) requiring joint state tax filing for all California registered Domestic Partners for 2007 taxes; advantages and disadvantages to the state's new Domestic Partner laws including AB205, SB565 and 401(k) inheritance; retirement tax planning; issues impacting families with children of domestic partners; and other related topics. A considerable portion of the workshop will be set aside to answer questions.

One of the new laws, SB 559, County Assessor Larry Stone will discuss directly the benefits to domestic partners who were registered and owned property between 2000 and 2006. Introduced last year by State Senator Chris Kehoe, the new law retroactively extends to domestic partners—registered between January 1, 2000, and December 31, 2005--the same property tax benefits afforded domestic partners that registered on or after January 1, 2006. The benefits of the law are provided on a prospective basis only. The statute was signed into law by Governor Arnold Schwarzenegger effective January 1, 2008.

Up until SB 559’s passage, only domestic partners who registered with the Secretary of State after January 1, 2006, were excluded from reassessment when a registered domestic partner was added or removed from property title, whether by deed or by death. The law requires that the property interest must be conveyed to the registered domestic partner remaining on title. However, registered domestic partners who made the same changes between 2000 and 2006 were not excluded and therefore reassessed. This law enables asssessors to correct this anomaly and provide prospective relief to qualifying taxpayers.

The deadline to apply for the exclusion is June 30, 2009. Taxpayers who apply and qualify will receive notice of a correction to their assessment. Applications that are received and approved prior to January 1, 2009, will see the reduction reflected on their October 2009 tax bill. Applications received and approved between January 1, 2009, and June 30, 2009, will see the reduction reflected on their October 2010 tax bill. The new law does not provide for refunds for prior tax years.

The new law excludes transfers of real property and mobile homes between domestic partners registered in the State of California from the meaning of “change in ownership” that in other circumstances would result in reassessment for property tax purposes.

To apply for the benefit, taxpayers are asked to complete a simple one-page form available on the Assessor’s website at www.sccassessor,org, together with a copy of the Certificate of Registered Domestic Partnership. There is no filing fee to apply for this exclusion.
